Last updated: March 2026
1. Acceptance of Terms
By accessing or using the website shrivatsajodhpur.com (“Website”), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions (“Terms”). If you do not agree with any part of these Terms, please do not access or use the Website. Your continued use of the Website constitutes your acceptance of these Terms in their entirety.
2. Eligibility
You must be capable of forming legally binding contracts under the Indian Contract Act, 1872 to use this Website. By using the Website, you represent and warrant that you are at least 18 years of age, or, if you are a minor, that you have obtained the consent of a parent or legal guardian to access and use the Website on your behalf.
3. Use of Website
SHRIVATSA grants you a limited, revocable, non-exclusive, and non-transferable license to access and use the Website solely for personal, non-commercial purposes. This license does not include the right to collect or use any product listings, descriptions, or prices for commercial purposes; to make any derivative use of the Website or its contents; or to download, copy, or otherwise exploit the Website content for any purpose other than personal browsing and inquiry.
4. User Conduct
When using the Website, you agree not to engage in any of the following prohibited activities:
- Attempting to gain unauthorised access to the Website, its servers, or any connected systems (hacking).
- Uploading, distributing, or transmitting any malware, viruses, or other harmful software.
- Impersonating any person or entity, or falsely representing your affiliation with any person or entity.
- Using automated scripts, bots, or scrapers to extract data from the Website without prior written consent.
- Sending unsolicited communications, spam, or promotional material through the Website.
- Engaging in any activity that is unlawful, fraudulent, or harmful to SHRIVATSA or its users.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately of any unauthorised use.
5. Products & Pricing
All products displayed on the Website are subject to availability. SHRIVATSA operates on a “Price on Request” model — final prices are communicated directly during private consultation and may vary based on materials, craftsmanship, and customisation requirements. Prices listed, where applicable, are indicative and subject to change without prior notice.
Product images on the Website are representative and provided for illustrative purposes only. As each piece is handcrafted by our artisans, natural variations in colour, texture, weight, and finish are inherent characteristics of our jewellery and should be expected. Such variations are not considered defects.
Custom and bespoke orders are subject to separate terms and conditions that will be discussed and agreed upon during your personal consultation with our team.
6. Orders & Customisation
Orders are confirmed only after mutual agreement between you and SHRIVATSA on the design specifications, materials, pricing, and estimated timeline. No order shall be deemed binding until such confirmation is provided by SHRIVATSA in writing.
Custom and bespoke orders may require an advance payment as discussed during consultation. The advance amount, payment schedule, and delivery timeline will be communicated at the time of order confirmation.
Cancellation of custom orders is subject to the extent of work already completed. Once craftsmanship has commenced, cancellation charges may apply proportionate to the work undertaken. SHRIVATSA reserves the right to retain any advance payments to cover costs already incurred.
7. Intellectual Property
All content on the Website — including but not limited to text, images, photographs, illustrations, designs, logos, trademarks, trade names, graphics, and branding — is the exclusive property of SHRIVATSA or its licensors and is protected under applicable intellectual property laws of India and international treaties.
Unauthorised reproduction, distribution, modification, display, or use of any content from the Website, in whole or in part, is strictly prohibited and may result in legal action. No right, title, or interest in any content is transferred to you by virtue of accessing the Website.
8. User-Submitted Content
By submitting any content to the Website — including reviews, testimonials, photographs, or other materials — you grant SHRIVATSA a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to use, reproduce, modify, adapt, publish, translate, display, and distribute such content across any media and platforms for promotional, marketing, or operational purposes.
You represent and warrant that you own or have the necessary rights to the content you submit and that such content does not infringe upon the intellectual property or privacy rights of any third party.
9. Disclaimer of Warranties
The Website and all services, content, and materials provided through it are offered on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. SHRIVATSA expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant or guarantee that the Website will be available at all times, that access will be uninterrupted or error-free, or that the content is accurate, complete, or current. Your use of the Website is at your sole risk.
10. Limitation of Liability
To the fullest extent permitted by applicable law, SHRIVATSA, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your access to, use of, or inability to use the Website, even if SHRIVATSA has been advised of the possibility of such damages.
11. Force Majeure
SHRIVATSA shall not be held liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control. This includes, but is not limited to, natural disasters, floods, earthquakes, epidemics, pandemics, acts of God, war, terrorism, civil unrest, government actions or restrictions, labour disputes, power failures, or disruptions in telecommunications or internet services.
12. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts located in Jodhpur, Rajasthan, India.
13. Dispute Resolution
In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties agree to first attempt resolution through good-faith negotiation. Either party may initiate such negotiation by providing written notice to the other party.
If the dispute remains unresolved within thirty (30) days of such notice, it shall be referred to and finally resolved by binding arbitration in Jodhpur, Rajasthan, in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time. The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties. The language of the arbitration shall be English.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.
15. Modifications
SHRIVATSA reserves the right to update, amend, or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting the revised Terms on the Website.
